Fue en una casa vecina a la del m\u00fasico Gustavo Cerati donde la memoria finalmente habl\u00f3, y con ella, emergi\u00f3 una causa que Usina de Justicia abraza desde sus or\u00edgenes: la imprescriptibilidad de los homicidios.<\/p>\n\n\n\n<p>Los familiares de Diego que a\u00fan viven no tendr\u00e1n justicia. No tendr\u00e1n esa verdad que el fallecido padre de la v\u00edctima busc\u00f3 incansablemente desde el primer d\u00eda, pues la acci\u00f3n penal prescribi\u00f3: ya transcurri\u00f3 el plazo legal para juzgar y condenar al responsable de su muerte.<\/p>\n\n\n\n<p>Uno de los argumentos m\u00e1s comunes a favor de la prescripci\u00f3n de los delitos, incluso los m\u00e1s graves como el homicidio, es que \u201ccon el paso del tiempo se pierden las pruebas\u201d. Sin embargo, la realidad y el avance de las ciencias forenses desmienten este dogma que algunos todav\u00eda se resisten a abandonar.<\/p>\n\n\n\n<p>En Estados Unidos, por ejemplo, existen cientos de casos en los que, d\u00e9cadas despu\u00e9s de haberse cometido un asesinato, se logr\u00f3 condenar al culpable gracias a pruebas preservadas o recuperadas con nuevas tecnolog\u00edas. Uno de los m\u00e1s emblem\u00e1ticos es el caso de Joseph James DeAngelo Jr., el criminal serial de California que cometi\u00f3 50 violaciones y por lo menos 13 homicidios entre 1976 y 1986. Su impunidad lleg\u00f3 a su fin cuando un investigador subi\u00f3 el ADN de Joseph a la base de datos abierta de perfiles gen\u00e9ticos GEDmatch, lo que permiti\u00f3 encontrar a familiares lejanos del sospechoso. Con una muestra de ADN de DeAngelo sacada de la basura, lograron identificar al asesino en serie y condenarlo a 11 prisiones perpetuas, el 21 de agosto de 2020.&nbsp;<\/p>\n\n\n\n<p>Otro caso fue el de John Floyd Thomas Jr., un asesino serial que mat\u00f3 a siete mujeres en Los \u00c1ngeles durante las d\u00e9cadas de 1970 y 1980. En el a\u00f1o 2005 se descubri\u00f3 que la evidencia biol\u00f3gica encontrada-y que no hab\u00eda sido examinada hasta ese entonces-tambi\u00e9n coincid\u00eda con la evidencia encontrada en la escena del crimen de Elizabeth McKeown, quien fuera agredida sexualmente y asesinada por Floyd en marzo de 1976. En 2011, Floyd fue condenado a prisi\u00f3n perpetua.&nbsp;<\/p>\n\n\n\n<p>Los familiares de las v\u00edctimas de DeAngelo y Floyd tuvieron la justicia que no tendr\u00e1 la familia de Diego.<\/p>\n\n\n\n<p>\u00bfQu\u00e9 mensaje le dejamos al mundo cuando aceptamos que matar puede prescribir? \u00bfDesde cu\u00e1ndo el tiempo borra un crimen? \u00bfDesde cu\u00e1ndo la ausencia caduca?<\/p>\n\n\n\n<p>Decir que un asesinato puede prescribir es afirmar que el dolor tiene fecha de vencimiento, que la b\u00fasqueda tiene un l\u00edmite, y que triunfar\u00e1 la impunidad.<\/p>\n\n\n\n<p>Por eso hoy alzamos la voz y decimos basta. Los derechos a la verdad y a la justicia no prescriben.<\/p>\n\n\n\n<p>Tu apoyo es m\u00e1s que un gesto solidario.
