Se trata de la decisi\u00f3n judicial de dar lugar a la medida cautelar presentada por el <strong>Observatorio del Derecho a la Ciudad<\/strong>, que ped\u00eda la protecci\u00f3n del <strong>Pasaje Mas\u00f3n<\/strong>.<br>&nbsp;<br>Desde el Observatorio presentaron la medida al detectar que la construcci\u00f3n de un edificio violaba el procedimiento de doble altura puesto por la Legislatura. El juez<strong> Osvaldo Otheguy<\/strong>, del Juzgado en lo Contencioso y Administrativo de la Ciudad N\u00b0 8, decidi\u00f3dar lugar a pedido y suspender la construcci\u00f3n del edificio en el Pasaje Mason al 4435 en el barrio de Palermo.<br>&nbsp;<br>El inicio del conflicto tiene que ver la sanci\u00f3n de la Ley N\u00b0 6361, mediante la cual se suprimen y modifican algunos art\u00edculos del C\u00f3digo Urban\u00edstico. Uno de los art\u00edculos modificados aument\u00f3 la altura permitida por lo que la obra del edificio de Pasaje Mason estar\u00eda habilitada.<br>&nbsp;<br>Sin embargo, el magistrado consider\u00f3 que la incorporaci\u00f3n de este art\u00edculo que habilitaba la edificaci\u00f3n en el C\u00f3digo Urban\u00edstico no respet\u00f3 el procedimiento de doble lectura que establece la Constituci\u00f3n de la Ciudad.<br>&nbsp;<br>Seg\u00fan consign\u00f3 Tiempo Judicial, el magistrado se\u00f1al\u00f3 que la modificaci\u00f3n fue incorporada en el recinto durante la segunda aprobaci\u00f3n de la Ley N\u00b0 6361; por lo que no estuvo presente ni en la aprobaci\u00f3n inicial en la ley, ni en la audiencia p\u00fablica ni en el despacho del proyecto durante la segunda lectura. Por el contrario, la \u201cexcepci\u00f3n\u201d fue incorporada en el \u00faltimo momento violando las instancias de transparencia y participaci\u00f3n ciudadana.<br>&nbsp;<br><strong>Jonatan Baldiviezo<\/strong>, abogado del Observatorio del Derecho a la Ciudad y de El Movimiento La Ciudad Somos Quienes La Habitamos, consider\u00f3 que \u201cen la Ciudad de Buenos Aires, existe una inseguridad jur\u00eddica muy grave para la ciudadan\u00eda\u201d.<br>&nbsp;<br>\u201cLa Legislatura aprueba leyes que no respetan el procedimiento de sanci\u00f3n de leyes que establece la Constituci\u00f3n.
